Occupational Safety and Health Complaints Mechanism


Workers and employees at RSC covered factories, and their representatives, can raise safety and health concerns safely and confidentially through the Occupational Safety and Health Complaints Mechanism (SHCM), supported by a team of RSC staff specialised in investigating and resolving complaints.

Since 1 June 2020, the Occupational Safety & Health Complaint Mechanism has been operated by the RSC. Accord brand and union signatories are tasked with ensuring that the SHCM continues to provide workers with access to remedy, independently and autonomously.

During the course of investigating, RSC complaint handlers will determine the remedy/remediation requirements in regard to safety and health. The RSC team works with complainants and factory management to ensure that the requirements are fully implemented.

If factory management does not comply with the required remediation/remedy of the SHCM, the RSC will implement a notice and warning process, which may lead to the termination of the business relationship.

The Occupational Safety and Health Complaint Mechanism offers workers in the following rights:


  • The right to refuse unsafe work;
  • The right to participate in the work of their factory Safety Committee;
  • The right file a complaint when they see a safety problem in their factory;
  • The right to protection against reprisal for reporting safety-related matters;
  • The right to Freedom of Association in relation to protecting their own safety.

Description

The Complainant alleged a worker was instructed to resign with 2 months' notice, after she informed Factory Management she was pregnant and tried to submit her pregnancy-related documents. The Complainant reported that, as a consequence, the worker stopped reporting for work at the factory. The Complainant's proposed remedy was for Factory Management to accept the worker's pregnancy-related documents and for the worker to be reinstated to her previous position at the factory.

Outcome

The RSC dispatched four members of the RSC Occupational Safety and Health Complaints Mechanism to conduct an unannounced investigation at the factory. During the factory investigation, Factory Management agreed to accept the worker's pregnancy-related documents and reinstate her as an existing employee. The worker came to the factory and, in the presence of the RSC, submitted her pregnancy-related documents and was reinstated to her previous position as an existing employee. The RSC confirmed that the worker considered the matter resolved.

Description

The Complainant alleged 2 workers were not paid their due separation from employment entitlements, after they left their employment at the factory. The Complainant alleged that 1 worker was forced to sign his/her final settlement documents but was not paid his/her service benefits (15 years). The Complainant's proposed remedy was for: 1 worker, who reportedly resigned with 2 months' notice, to be paid his/her due service benefits (15 years); and 1 worker, who was reportedly terminated, to be paid his/her due earned wages (2 months, 20 days) and other due separation from employment entitlements, including earned leave encashment and termination benefits.

The Complainant alleged a worker was not assigned any work for 3 days because the worker failed to meet the production target. The Complainant reported that, as a consequence, the worker stopped reporting for work at the factory. The Complainant’s proposed remedy was for the worker to be immediately reinstated to his/her position at the factory or, if not reinstated, paid his/her due wages and earned leave encashment.

The Complainant alleged s/he was instructed to resign from employment at the factory after s/he had been absent from work without authorisation (3 days). The Complainant reported that she refused to resign and left the factory. The Complainant informed the RSC that she was pregnant. The Complainant’s proposed remedy was to be immediately reinstated to her previous position at the factory.

Outcome

The RSC informed Factory Management by telephone about the allegations and the Complainant's proposed remedy. Factory Management subsequently informed the RSC that the Complainant had been reinstated to her previous position at the factory. The RSC confirmed with the Complainant that she was working in her previous position and that she considered the matter resolved. In a notification sent to Factory Management and relevant brand and labour signatories, the RSC reminded Factory Management that the RSC safety and health complaints mechanism provides protection against reprisal for raising a complaint with the safety and health mechanism and that reprisal or retaliation towards any worker for raising a complaint would represent a violation of signatory brands' requirements.
